Airlines and Crew of Indira Gandhi International Airport

Crewmembers are required to submit the correct declaration before Custom authorities with respect to the currency gold ornaments and electronic goods etc. in their possession on arrival as well as departure.

Crew member is allowed to bring items like chocolates, cheese, cosmetics and other petty gift items for their personal or family use upto a value of Rs. 600 only at the returning of the Aircraft from foreign journey. However, a crew member on final pay off or at the termination of his engagement with the Airline shall be eligible for allowances as a common passenger.

 

Diplomats of Indira Gandhi International Airport

India is a signatory to the Vienna Convention on Diplomatic Relations, 1961 which, interalia, governs the immunities from Customs duties and exemption of baggage of diplomatic personnel

Diplomatic and other staff are divided in various categories, for the purpose of Customs duties :

i. Head of the Mission – Ambassador, High Commissioner
ii. Career Counsular officers
iii. Administrative and Technical staff
iv. Locally recruited persons.

Diplomatic persons mentioned at (i) & (ii) above are entitled to exemption from inspection of their personal baggage unless there are serious grounds for believing that it contains articles not covered by exemptions or immunities available to them. The baggage is not be examined without prior consultation with the Protocol Division of the Ministry of External Affairs. Moreover, the baggage examination must only be undertaken in the presence of the diplomatic person or his authorised representative.

Exemption from Customs duties is available to all career consular officers throughout the tenure of their appointment in India. They can import personal and household effects and other articles, including motor vehicles, intended for their own use or for the use of their families till four months from the date of their first arrival to take-up their appointment in India. On the basis of reciprocity they have also been granted “tenure privileges” which entitle them to import their requirements as above throughout their tenure in India as long as they continue to normally reside in India and do not indulge in any gainful private occupation.

Members of administrative and technical staff are allowed the goods free of duty on their first arrival within the limits fixed under Baggage Rules.

Locally recruited staff is not entitled to any exemption..

Exemptions to officials of UNO

Privileges of the UNO organisations, its specialised agencies in India and their officials are covered by the provisions of the Schedule to U N (Privileges and Immunities) Act, 1947. Basically the U N personnel have the right to import free of duty their personal effects at the time of first taking up their post in India subject to condition that the goods will be re-exported. Indian nationals working as international civil servants in the regional office of the United Nations, including in India, which cover not only India but also other countries, are also granted the same facilities and privileges as available to foreign nationals working in similar positions in India. The exemption is available for import for own official use and not for projects funded by UN.

 

Functions of Indira Gandhi International Airport

Indian Customs along with other border agencies is the custodian of the entry and exit points of the country. IGI Airport is one such port through which huge traffic of passengers and cargo takes place.

Indian Customs at IGI Airport is assigned a number of tasks more important of which are: -

(i) Collection of customs duties on imports and exports as per basic Customs laws (Customs Act, 1962 and Customs Tariff Act, 1975);
(ii) Enforcement of the various provisions of the Customs Act governing import and export of cargo, baggage, postal articles and arrival & departure of vessels, air crafts etc.;
(iii) Discharge of various agency functions and enforcing various prohibitions and restrictions on imports and exports under Customs Act and other allied enactments;
(iv) Prevention of smuggling including interdiction of narcotics drug trafficking; and
(v) International passenger processing.

Of around 40 allied enactments enforced by Indian Customs, major ones are Foreign Exchange Management Act, Narcotics and Drugs Prevention Act, Wildlife Act, Arts and Antiquities Act, Arms and Ammunition Act, Foreign Trade (Development and Regulation) Act. For further see Section on Acts

At IGI airport all incoming passengers after immigration clearance have to pass through Customs. The Department has the onerous duty to ensure that there is maximum facilitation and quick passenger clearance. But at the same time it needs to be seen that the passengers do not try to smuggle goods into the country which are sensitive and otherwise prohibited/restricted or where substantial duties may be involved which are sought to be evaded by non-declaration/ mis-declaration to Customs. Similarly Customs have to ensure that outgoing passengers do not smuggle out foreign currency, antiques or other wildlife & prohibited items or narcotics drugs & psychotropic substances.

Customs enforcement is by:

i. Regular checks
ii. Profiling- both front end and back end by advance passenger information system
iii. CCTV surveillance
iv. Use of x ray machines
v. Use of hand held metal detectors/door frame metal detector
vi. Use of ion scan (for narcotics)
vii. Dog squad
viii. Rummaging of flights
ix. Tarmac control
x. Surveillance
xi. Interaction/coordination with airlines staff & inputs from them
xii. Interaction/ coordination with other agencies like CISF, Police, Airport Authority of India & inputs received from them
